This policy also governs data collected during the delivery of our business-to-business services (the “Services”). By accessing or using the Platform or requesting our Services, as a business or its authorized representative ("you" or "Customer"), you acknowledge and agree to the terms set forth in this Privacy Policy. Any capitalized terms not explicitly defined herein shall have the meanings assigned in the Customer Terms.

1. Collection of Personal Information

By requesting CostFixers' Services, accessing the CostFixers Portal or website, or communicating with us in a business capacity, you consent to our collection of business-related information. This information may be gathered when your business contacts us in writing, online, or verbally with our team members. Additionally, business usage data may be collected automatically via technologies such as cookies to support portal functionality and analyze usage.
While the majority of information is obtained directly from your business, we may also receive business contact information or vendor account data from authorized third parties. CostFixers does not collect unnecessary personal data such as Social Security Numbers, dates of birth, or demographic information. Our collection practices are limited to business information necessary for providing our services and are conducted fairly and lawfully.
The business information collected may include, but is not limited to, business contact information, vendor account credentials, billing records, contracts and invoices, negotiation notes, and portal usage data. This data supports the provision of CostFixers' Services, improvements to and personalization of the Portal, and effective business customer support.
Your business retains the option to withhold certain business information or withdraw consent; however, this may restrict our ability to provide Services. We will retain business information as needed to deliver Services, address disputes, provide support, and comply with legal, audit, or regulatory obligations, consistent with applicable laws and our Customer Terms.

2. Data Owner

"Data Owner" refers to the business entity or individual who has legal authority and responsibility over the business information provided to CostFixers via the Platform or during the delivery of Services. The Data Owner determines the purposes and means of processing such information and retains the right to update, correct, or request deletion of their business data as permitted under this Privacy Policy and applicable law.

3. Data Administrator

"Data Administrator" refers to the individual(s) or entity designated by the customer (Data Owner) to manage, process, and maintain business information on behalf of the Data Owner. CostFixers acts solely as a data processor/administrator on behalf of the Data Owner and does not have any ownership rights or interests in the data. The Data Administrator is responsible for implementing data management practices, ensuring data accuracy, and facilitating compliance with this Privacy Policy and applicable data protection regulations.

7. Credential Update

To maintain the security of business data and vendor accounts, all authorized users must update their account passwords at least every 90 days. In the event of multiple failed login attempts or detection of suspicious activity, affected accounts will be automatically locked out and require administrative review before access is restored. CostFixers will notify users of any required credential changes and provide instructions for account recovery as necessary.

8. Opt-Out Rights and Modifications to Personal Data and Usage Settings

Authorized business users may request access to the business information CostFixers has collected about their organization at any time. Users may also update or correct business contact information, vendor account credentials, or billing records as needed. Business users may request deletion of their organization’s data, subject to legal retention requirements and ongoing service obligations. CostFixers does not use business data for marketing or advertising purposes.

CostFixers collects only business-related data through your use of the Portal, including business contact information, vendor account credentials, billing records, contracts and invoices, negotiation notes, and portal usage data. CostFixers does not collect unnecessary personal data such as SSN, date of birth, gender, education, or demographic profiling. As a business customer, you have the right to request deletion of business data held by CostFixers, subject to exceptions for legal holds, audits, or regulatory requirements. Data retention timelines and deletion procedures are outlined in the Terms and Conditions, which are incorporated herein by reference.

The Service Provider shall retain all vendor bills, invoices, contracts, and negotiation notes for the entire term of this Agreement and for at least seven (7) years after the later of (i) the Agreement's expiration or termination, or (ii) the date such records are created or received. Credentials (including access logs, certificates, and API keys) shall be retained for a minimum of three (3) years after the later of (i) the Agreement's expiration or termination, or (ii) the date such credentials are created or received. All records must be maintained securely in compliance with applicable laws and industry standards, and made available to the Company upon reasonable request during the retention periods. Retention periods may be extended as required by law, litigation holds, or regulatory obligations.

10. Multi-Location Data handling​

Data stored at multiple company locations may be accessed only by authorized personnel of the Company with a legitimate business need, subject to applicable data protection laws and internal access controls. Each location must maintain records of access requests and approvals for cross-location data retrieval or modification. Remote access to data across locations shall be governed by Company security protocols, including multi-factor authentication and periodic access reviews.
Data pertaining to individual franchises or enterprise segments shall be logically separated to prevent unauthorized cross-segment access. Franchisees and enterprise segment managers are responsible for ensuring compliance with Company data governance standards within their respective domains. Shared data resources between segments will be documented, and access will be restricted to designated roles as defined by company policy.

11. Use of Tracking Information

CostFixers uses analytics tools and cookies within its B2B portal to monitor portal usage, system performance, and to improve user experience for business customers. No tracking technologies are used for advertising, behavioral profiling, or marketing purposes. Data collected through analytics includes portal usage statistics, device/browser type, and session duration, but does not include personal or demographic information. CostFixers does not share analytics data with third parties for advertising or marketing. All analytics and cookies are used solely for operational and security purposes within the CostFixers portal.
CostFixers uses cookies within its B2B portal to support secure login, maintain session integrity, and enable essential portal features for business users. Cookies do not contain personal or demographic information and are not used for advertising or marketing. Business users may adjust browser settings to manage cookies, but disabling cookies may limit access to certain portal features. All cookies are used exclusively for operational, security, and analytics purposes within the CostFixers portal.

12. Underage Access and Use of Platform

CostFixers provides services exclusively to businesses and does not offer its Platform or services to individuals, consumers, or minors. CostFixers does not collect or process personal information from children or individuals under any age threshold.
This Platform is intended solely for use by authorized business representatives. CostFixers does not permit registration, submission of data, or access to the Platform by individuals acting in a personal or consumer capacity, or by any minors.

13. Security

CostFixers protects the business data you provide, including business contact information, vendor account credentials, billing records, contracts, negotiation notes, and portal usage data, using security measures designed for B2B clients. CostFixers implements industry-standard encryption technology and access controls to secure data transmissions, vendor credentials, and stored information, and to prevent unauthorized access. Vendor credentials are encrypted and access is limited to authorized personnel only.
While these security protocols are designed to protect your business data, in the event of a security breach or vendor credential compromise, CostFixers will notify the customer promptly and within 72 hours of becoming aware of such breach. CostFixers is not liable for damages resulting from unauthorized access, use, or disclosure of business data or vendor credentials, except as required by applicable law.
The Customer is responsible for taking reasonable steps to maintain the security and confidentiality of all vendor account credentials provided to CostFixers for the purpose of delivering Services. While the Customer is expected to exercise care in managing its vendor accounts, both parties acknowledge that certain risks may exist beyond the Customer's direct control. CostFixers and the Customer will cooperate to address any suspected compromise or unauthorized use of vendor credentials. CostFixers shall not be liable for loss, damage, or liability arising from vendor-initiated actions, including but not limited to changes to vendor accounts, transactions, or data modifications, except as required by applicable law or in cases of CostFixers' negligence or willful misconduct. The Customer agrees to promptly notify CostFixers of any suspected compromise or unauthorized use of vendor credentials.

14. Portal Limitations and Availability Disclaimer

The Company endeavors to maintain continuous access to the portal and to minimize disruptions. However, the portal may be subject to scheduled maintenance, upgrades, or unforeseen outages, and uninterrupted availability cannot be guaranteed. The Company disclaims liability for any temporary unavailability, delays, or interruptions in portal access, whether due to technical issues, third-party service failures, or force majeure events. Users acknowledge that certain features or functionalities may be limited or unavailable at times and agree that the Company is not responsible for any loss or inconvenience resulting from such limitations. The Company will provide reasonable notice of planned maintenance whenever possible and will make commercially reasonable efforts to restore access promptly in the event of service interruptions.

15. Third Party Websites and Links

The Platform may include links to websites and services operated by third parties for the convenience of business users. CostFixers does not endorse, control, or review the content or practices of these third-party websites, and therefore does not assume any responsibility or liability for their policies, privacy practices, or actions.
These external sites are governed by their own terms of use and privacy policies, which business users should review prior to use. Accessing third-party websites through links on the Platform is done at the business user's own risk.
CostFixers disclaims any liability for damages or losses arising from the use of any third-party site, service, or platform that is not provided or controlled by CostFixers.

16. Changes to this Privacy Policy

CostFixers periodically reviews and updates this Privacy Policy to ensure ongoing compliance with applicable laws and alignment with our current practices and procedures. We may modify this Privacy Policy at any time, with changes effective upon posting the updated version on our website or portal.

Any dispute arising out of or relating to this Agreement, including breach, termination, validity, interpretation, or performance ("Dispute"), shall be governed by the Dispute Resolution clause set forth in the Terms and Conditions. All dispute resolution procedures, including arbitration, are subject to the provisions of the Terms and Conditions, which are incorporated herein by reference.

18. Language

This Privacy Policy may be published in multiple languages to facilitate access and comprehension for our customers. However, only the English version shall constitute the legal agreement between you and CostFixers. In the event of any inconsistency or conflict between a non-English version and the English version of this Privacy Policy, the English version shall prevail.
